CHEYENNE, Wyo. (AP) - A rejected plea agreement has a Cheyenne man going to jail for his dad's beating.

Peter Lovato pleaded guilty in February as part of an agreement with prosecutors that Laramie County District Court Judge Steven Sharpe rejected.

Public defender Don Miller said the 10 months Lovato had already spent in jail was enough. Sharpe said during a hearing Monday that probation would not have been appropriate considering the defendant's lengthy criminal history.

Tito Lovato told police his son was intoxicated when he punched him in the head at least three times, causing his eye to bleed and his lip to swell. He told the court Lovato started drinking 20 years before, when his son's mom died.

Lovato expressed remorse in court and was sentenced to one to two years in jail.
