CHEYENNE, Wyo. (AP) — The Laramie County District Attorney's Office says it won't seek the death penalty against a man charged with fatally shooting his ex-girlfriend and wounding her boyfriend.

Daniel Guajardo pleaded not guilty to murder Thursday in connection with the April 2015 death of Janessa Spencer.

Prosecutors say the case did not meet any of the state's requirements for proceeding with a death penalty case. Wyoming law requires prosecutors to meet at least one of 12 conditions.

Guajardo is accused of fatally shooting Spencer and wounding her boyfriend after breaking into her Cheyenne home.

Guajardo is also facing charges for an alleged jail assault.

His attorney says pleas of not guilty by reason of mental illness could be entered in the case.
