Judge Sides With Cheyenne in Officer-Involved Shooting Lawsuit
CHEYENNE, Wyo. (AP) - A U.S. district court judge has ruled that Cheyenne police did not act negligently when a man was shot by an officer in 2011.
The judge ruled Monday in favor of the City of Cheyenne and the Cheyenne Police Department.
The lawsuit was filed by Mathew Carabajal after he was shot by police in September 2011. An officer tried to stop his vehicle for driving erratically. Carabajal tried to evade arrest before eventually stopping. He later pointed his vehicle at officers and revved his engine, prompting an officer to fire two founds from a shotgun.
Carabajal says he was stopped without probable cause.
The city filed a motion last month asking the judge to rule instead of sending the lawsuit to trial in January.
