A 34-year-old Cheyenne man could face up to 19-and-a-half years in prison after police found him passed out in a stolen car with drug paraphernalia on his lap.

According to an affidavit, police were called to the Big D Exxon at 3030 E. Lincolnway around 10:30 a.m. on May 25 after receiving a report of a man sleeping in, what was later confirmed to be, a stolen car.

When police arrived, they found David Fugate passed out behind the wheel with a piece of surgical tubing on his lap. After knocking on the window several times, Fugate finally woke up and opened the door.

When police searched Fugate, they found a .45 caliber pistol tucked in his waistband, 3.8 grams of tar heroin, a small amount of methamphetamine and one ecstasy pill.

Authorities also found two oxycodone pills in Fugate's wallet when they were booking him into jail.

Fugate is charged with felony possession of heroin, receiving stolen property, misdemeanor possession of methamphetamine, misdemeanor possession of MDMA and misdemeanor possession of oxycodone.

Fugate posted $3,000 cash bond on May 30. His preliminary hearing is scheduled for June 7 at 1:30 p.m.
