A 43-year-old Cheyenne man is facing felony charges after reportedly, once again, being caught with drugs.

According to a booking sheet, police arrested John David Brown at Carey Avenue and West 8th Street at 1:09 a.m. on Saturday, Oct. 25.

Brown was booked into the Laramie County Detention Center and subsequently charged with possession of a controlled substance - third or subsequent offense.

It's alleged he had methamphetamine and was previously convicted of the same or similar offense on Dec. 20, 2013; Dec. 16, 2015; and Feb. 12, 2018, making it a felony punishable by up to five years in prison, up to a $5,000 fine, or both.

He was also charged with felony possession of methamphetamine, a crime punishable by up to seven years in prison, up to a $15,000 fine, or both.

Initial Court Appearance

On Tuesday, Oct. 28, Brown was seen in Laramie County Circuit Court in front of Judge Antoinette Williams on the charges.

Williams appointed Brown a public defender and his preliminary hearing was set for Wednesday, Nov. 5, at 1:30 p.m.

Williams then asked for the state's position regarding bond.

"The state would be recommending $5,000 cash in this matter," the state said. "Mr. Brown has a lengthy criminal history for drugs and given one charge is for felony weight and one's a third or subsequent the state believes that is appropriate ... to ensure the compliance of Mr. Brown while on bond and ensure the safety of the community."

Bond Set at $5K Cash

"Your bond is $5,000 cash, Williams told Brown. "If you post that I'll set your bond conditions."

Please remember that all defendants are presumed innocent until proven guilty.
