AP - A man accused of killing his ex-girlfriend and shooting her boyfriend has been ordered to undergo a mental evaluation.

The attorney for 26-year-old Daniel Guajardo filed a motion Thursday asking that his client receive a competency evaluation.  A Laramie County Circuit Court judge signed an order later that day, sending Guajardo to the Wyoming State Hospital for no more than 30 days of treatment and evaluation.

Prosecutors say Guajardo fatally shot 26-year-old Janessa Spencer after breaking into her Cheyenne home in April.  Her boyfriend, 24-year-old Samuel Cook, survived a gunshot wound to the back.

Guajardo has been charged with first-degree murder, attempted first-degree murder and aggravated burglary.  He could face the death penalty.

The hospital will decide whether Guajardo is fit to stand trial.
