Two brothers are facing felony charges following two separate burglaries in Cheyenne.

According to booking sheets, 42-year-old transient James Matthew Case and 40-year-old Cheyenne transient Joshua Timothy Case were arrested at 11:08 a.m. on Monday, Jan. 19, after police observed and contacted them at the McDonald's at 410 S. Greeley Hwy.

Both were booked into the Laramie County Detention Center and subsequently charged with two counts of burglary, a felony punishable by up to 10 years in prison, up to a $10,000 fine, or both.

The burglaries are alleged to have occurred on or about Friday, Jan. 16, and Saturday, Jan. 17.

Joshua was also charged with misdemeanor interference with a peace officer - no injury, a crime punishable by up to one year in jail, up to a $1,000 fine, or both.

Initial Court Appearances

On Wednesday, Jan. 21, the two were seen in Laramie County Circuit Court in front of Judge Antoinette Williams on their charges.

Williams appointed the two public defenders and set their preliminary hearings for Friday, Jan. 30, at 9:45 a.m.

Williams then asked for the state's position regarding bond.

"I've reviewed the federal criminal history, your honor, and I would note that there are no priors for Mr. James Case, however, due to the nature of these charges, particularly allegations of breaking into a home and stealing items, that is concerning," the state said.

"It looks like Mr. Joshua Case has some prior contacts with this court last year, most concerning interference with a peace officer. That's consistent with the charges here where the allegations against Mr. Case are that upon contact by law enforcement, he locked himself in a bathroom and then tried to escape on foot. He obviously was unsuccessful, but that does leave the state with concerns," the state added, recommending $10,000 cash bonds.

Bonds Set at $10K Cash

Joshua asked Williams if he could get a signature bond, but Williams told him, "Not at this time," setting both the men's bonds at $10,000 cash.
