Luke Martinez Sentenced in Criminal Battery Case

A former Wyoming basketball player accused of kicking a man in the face during a bar fight has been sentenced in the case.

Lucas W. Martinez has been ordered to serve 45 days in jail, with credit for 4 days already served, and is facing a fine of $750, $300 payment to the victims compensation fund, $40 court costs, and $58,000 in restitution to the victim.

Martinez was accused of kicking a man who was unconscious. The fight happened in late December, 2012, outside a Laramie bar.  Martinez, of Bismarck, N.D., was suspended from the team following the incident. He was averaging 14.5 points a game before his suspension.

University of Wyoming spokesperson, Chad Baldwin, confirms that Martinez was no longer on the team as his eligibility had expired.

Felony charges of aggravated assault that had been originally filed against Martinez in Albany County District Court were dismissed on August 8th, following a request to do so by the County Attorney’s office.  The case was then refiled in Albany County Circuit Court, under a charge of misdemeanor battery.

A call to the County Attorney’s office was not immediately returned.

Martinez was named in a civil lawsuit related to the case earlier this year.   Steve C.M. Aron, who represents the victim, Parfait Nayigihugu, says that lawsuit is still pending.  The lawsuit seeks unspecified damages.
