Judge Denies Preliminary Injunction in Hill Lawsuit

State Superintendent Cindy Hill

A district judge in Cheyenne has rejected state schools Superintendent Cindy Hill’s request to have her powers and duties immediately restored. Judge Thomas Campbell on Wednesday refused to issue a preliminary injunction in a lawsuit Hill has filed challenging the constitutionality of her job changes. Campbell also sent the lawsuit directly to the Wyoming Supreme Court for further action.

The Legislature and Gov. Matt Mead approved a law this winter taking away many of the superintendent’s powers and duties. It included replacing the superintendent as administrative head of the state Education Department with a director appointed by the governor. The superintendent remains a statewide elected official.

In his ruling Judge Campbell said the plantiff’s had failed to provide sufficient evidence that irreperable harm to the plaintiffs, students, teachers and other stakeholders has nor will occur in the time it takes the Wyoming Supreme Court to decide the case. He added that the plaintiffs also did not establish the likelihood that they will suceed on the merits of the case and overcome the presumption of the laws constitutionality.
