An arm wrestling match between the city and county has one South Cheyenne property owner caught in the middle.

Laramie County Commissioners, Tuesday afternoon, postponed voting on the O'Brien Subdivision permit and plat, which would allow for business expansion behind the empty convenience store on the northeast corner of College Drive and South Greeley Highway.

Laramie County Attorney Mark Voss encouraged commissioners to send the item back to the City Council's Public Services Committee, saying language in the map was a direct violation of a Wyoming Supreme Court decision.

"We need to get this language either completely dropped or get it clarified. Unfortunately, I think it's going to end up going to the Supreme Court in order to make that decision," said Commissioner Linda Heath. "The Supreme Court, at one point in time, has ruled on it, but, at this point in time, we have property owners who are wanting to develop their land and this kind of language is getting in the way of them being able to do what they want to do with their property."

Heath says South Cheyenne is growing and there needs to be some flexibility to allow for future expansion.

"I don't see this going away in the future unless we get this language cleared up," said Heath. "I don't want to see our property owners continue to be caught in the middle between the city and the county on this. This is totally unnecessary."

The Commission will revisit the issue when it meets again on September 15.
