Case said that normally the city council must sign off on expenditures of over $35,000 but that there is an exemption for emergency situations. He said he doesn't feel the potholes on Cheyenne streets right now meet that definition.

Cheyenne Mayor Marian Orr, in a memo to city council members, says the council doesn't seem to understand how the city's government is supposed to operate.

Councilman Case said on Friday " I'm not sure how this rises to the level of an emergency, to spend that kind of money without council approval."

The city has also asked local residents to report potholes so crews can fix them promptly.
