Oliver Curtis Birt, 29, of Cheyenne, appeared in Laramie County Circuit Court in front of Judge TJ Forwood on a single count of aggravated vehicular homicide - DUI, a felony punishable by up to 20 years in prison, up to a $10,000 fine, or both.

The Crash
According to police, the crash happened around 4:25 p.m. on Wednesday at the intersection of East Lincolnway and Western Way.
Police say Birt was headed southwest on East Lincolnway in a white pickup when he attempted to make a left-hand turn onto Western Way and collided with an oncoming blue Harley-Davidson motorcycle being ridden by a 69-year-old Cheyenne man.
Police say the motorcyclist, identified in court as Tim Waters, sustained life-threatening injuries at the scene and was later pronounced deceased at Cheyenne Regional Medical Center.
$250K Cash Bond
Forwood tentatively appointed Birt a public defender and, at the recommendation of the state, set his bond at $250,000 cash.
Birt told Forwood he believed he could post bond and Forwood set conditions, ordering him to enroll in the 24/7 program upon his release from jail.
Birt's next court date will be a preliminary hearing on Thursday, Oct. 23, at 1:30 p.m.
Please remember that all defendants are presumed innocent until proven guilty.
