State Asks For Rehearing in the Cindy Hill Case

The Office of the Attorney General has decided to seek a rehearing from the Wyoming Supreme Court of its recent decision in Powers v. Mead. In a 3-2 decision released Tuesday the Court declared Senate File 104, (aka the Hill Bill) unconstitutional.  Attorney General Peter Michael. in a news release. said “after reviewing the opinion, the concurrence, and the dissent, I believe additional consideration is merited.”

The deadline to file a petition for rehearing under court rules is 15 days following the opinion. A party seeking rehearing submits its arguments at that time. If granted, the Court decides whether to stay the effect of its decision until the rehearing is decided. If denied, the Court would proceed to send the answers to the certified questions to the district court for further proceedings.
