Laramie County District Attorney Jeremiah Sandburg says the failure of the state legislature to pass a bill on pot edible products during the recent session means possessing the products in baked or candy form with the plant cooked in will remain a misdemeanor

But the D.A. says when the pot product is in a liquid form it can be charged as a felony in amounts of .3 of a gram or more.

Sandburg says the problem with felony charges in baked or candy products is that because the plant breaks down there is no way of proving how much actual marijuana is contained in the product.

State lawmakers earlier this year considered a bill that would have made possession of three ounces or more of pot edibles a felony, but the proposal died without winning final approval.

A legislative committee is set to consider the issue again before the 2017 legislative session.

State law enforcement officials and prosecutors say the law needs to be clarified because more pot edibles are showing up in Wyoming since Colorado outlets began legally selling recreational marijuana products in 2014.
