A 26 year old man who is accused of murdering his ex-girlfriend and trying to kill another man could potentially face the death penalty, although prosecutors say that decision hasn't been made yet.

Daniel Guajardo allegedly fatally shot 26 year old Janessa Spencer, his former girlfriend, last month. He is also accused of shooting 24 year old Sam Cook, who was wounded in the shoulder but survived.

Guajardo was eventually arrested in Fort Collins, but not extradited to Wyoming until this week. He faced his initial court appearence in Laramie County Circuit Court on Wednesday. In addition to First Degree Murder and Attempted First Degree murder he is also charged with Aggravated Burglary.

Prosecutors said Wednesday they haven't decided whether to ask for the death penalty if he is convicted on the murder charge. Guajardo remains in custody in the Laramie County Detention Center pending a scheduled May 15 preliminary hearing.

The results of that hearing will determine whether Guajardo is bound over for trial.
