A law that was enacted over a century ago to help keep Cheyenne residents from contracting tuberculosis and the Spanish flu bit the dust Monday night.

The Cheyenne City Council voted 7 to 2 to amend a section of the city code which outlawed folks from spitting on Cheyenne sidewalks.

"The CDC and the Wyoming Health Department will notify you, just like gonorrhea and syphilis, if there's Spanish influenza and tuberculosis out there," said Councilman Richard Johnson, who sponsored the ordinance. "It shouldn't be a law."

"It's not enforced and there's really not a reason for it anymore," said Police Chief Brian Kozak. "We never have written a ticket, at least in the records that we have."

Councilman Dr. Mark Rinne and Mayor Rick Kaysen voted against the ordinance. Councilman Dicky Shanor was absent from the meeting.
