A 26-year-old Cheyenne man could face up to 25 years in prison after being charged with aggravated child abuse in the death of his infant son.

According to arrest records, Tyler Miller was taken into custody on March 3 by a deputy executing a warrant.

Court documents say Miller and the baby’s mother took the boy, who was nearly four months old at the time, to Cheyenne Regional Medical Center around 9:30 a.m. on April 3, 2016.

The two told emergency department personnel that the baby had been wheezing, coughing and acting fussy.

The baby was found to have subdural hematoma and was taken to Children’s Hospital Colorado where he died a week later.

The boy’s mother reportedly told police that Miler was “crabby” when he came home from work shortly after 1 a.m. on April 3, but both denied inflicting any injury upon the child.

She said the baby was fine when she put him to bed around 11:30 p.m. on April 2, but he woke up around 5 a.m. breathing rapidly and having rapid stomach movements.

Miller told police that the baby started fussing around 3 a.m., but he gave him a pacifier and the child fell asleep.

Hospital records indicated the boy had “retinal hemorrhages involving multiple layers of the retina” in both eyes and “extensive cerebral injury” consistent with abusive head trauma.

Dr. Svendsen, who treated the baby at Children’s, stated her medical opinion was that the child’s injuries were the result of child abuse.

She also said the baby had a healing, partially-torn frenulum inside his mouth, which is often seen when parents, who are often frustrated, attempt to force-feed a child a bottle or force a pacifier in their mouth.

Miller is being held in the Laramie County Jail on $10,000 cash bond. His preliminary hearing is scheduled for March 17 in Laramie County Circuit Court.
